An example of this is The Water Environment (Controlled Activities) (Scotland) Regulations 2005.

Regulations

A CAR authorisation is intended to control impacts on the water environment, including mitigating the effects on other water users.   

Three different types of authorisation under CAR allow for proportionate and risk-based regulations. 

The three levels of authorisation are: 

  • General Binding Rules
  • Registration
  • Licence

When considering an application for authorisation, SEPA will assess the effect upon ecology, upon other water users and the extent to which the proposals affect flood risk.
